Welcome to the ShiftTrace Beta Program. By accessing or using the ShiftTrace application ("Software"), you agree to be bound by these Terms of Use.

1. Beta Software Acknowledgment

You acknowledge that the Software is in a beta testing phase. It may contain bugs, errors, and other problems that could cause system failures or data loss. The Software is provided "as is" and "as available" without warranties of any kind.

2. No Guarantee of Uptime

We do not guarantee that the Software will be continuously available, uninterrupted, or error-free. We may suspend or terminate access at any time for maintenance, updates, or at our discretion.

3. Feedback Use

We welcome your feedback, ideas, and suggestions ("Feedback"). By submitting Feedback, you grant us a worldwide, royalty-free, perpetual, and irrevocable license to use, modify, and incorporate your Feedback into the Software without any obligation to you.

4. Customer Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to ensure that any workers or team members utilizing the Software under your company's account comply with these terms.

5. Prohibited Conduct (No Unlawful Use)

You agree not to use the Software for any unlawful, discriminatory, or harmful purpose. You must not upload content that infringes upon third-party rights or violates local laws regarding privacy and employment.

6. No Copying or Reverse Engineering

You agree not to copy, modify, distribute, sell, lease, reverse engineer, or decompile any part of the Software, nor attempt to extract the source code or proprietary algorithms.

7. Limitation of Liability

To the maximum extent permitted by law, ShiftTrace (and its founders/affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the beta Software.

8. Termination of Beta Access

We reserve the right to revoke, suspend, or terminate your beta access at any time, for any reason, with or without notice.
